Terms of Service

Please read these terms carefully before engaging our electrical services. By working with us, you agree to the conditions outlined below.

Agreement to Terms

These Terms of Service (“Terms”) govern the relationship between Kochs Electric (“we,” “us,” or “our”) and any individual, household, business, or organization (“Client,” “you,” or “your”) that requests, schedules, or receives electrical services from us.

By contacting us to request services, accepting a written estimate, signing a work order or service agreement, or permitting our technicians to perform work on your property, you confirm that you have read, understood, and agree to be bound by these Terms in full.

If you are entering into this agreement on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

Services Provided

Kochs Electric provides licensed electrical contracting services throughout the state of Indiana, including but not limited to:

  • Residential electrical installation, repair, and maintenance
  • Commercial electrical services and tenant improvements
  • Industrial electrical work and equipment wiring
  • EV charger installation (Level 1, Level 2, and DC fast charging)
  • Generator and backup power system installation and service
  • Solar electrical system integration and interconnection
  • Electrical panel upgrades and service changes
  • Electrical inspections, troubleshooting, and consulting

All services are performed by licensed electricians in accordance with applicable Indiana state codes, the National Electrical Code (NEC), and local municipal requirements. The scope of each project is defined in the applicable work order, estimate, or written agreement provided to you prior to work commencing.

Estimates & Pricing

Estimates provided by Kochs Electric are based on the information available at the time of assessment. Written estimates are valid for 30 days from the date of issue unless otherwise noted.

Estimates are not guaranteed final prices. Unforeseen conditions discovered during the course of work – such as non-compliant existing wiring, concealed damage, or code deficiencies – may require additional labor or materials. We will communicate any scope changes and obtain your approval before proceeding with work that falls outside the original estimate.

For time-and-material projects, you will be billed for actual hours worked at the agreed hourly rate, plus the cost of materials used. For fixed-price contracts, the agreed price covers the defined scope only; changes in scope will be handled through a written change order.

Material prices are subject to market fluctuation. If significant price changes occur between estimate and procurement, we will notify you in advance.

Payment Terms

Payment terms are specified in your estimate or service agreement. Unless agreed otherwise in writing:

  • Residential service calls and smaller repairs are due in full upon completion of work.
  • Larger residential and commercial projects may require a deposit prior to work beginning, with the balance due upon substantial completion.
  • Commercial and industrial contracts follow the payment schedule outlined in the signed project agreement.

Accepted payment methods include cash, check, and major credit and debit cards. Specific payment method availability may vary by project type.

Invoices not paid within 30 days of the due date are subject to a late fee of 1.5% per month (18% annually) on the outstanding balance. Kochs Electric reserves the right to suspend or withhold services on accounts with outstanding balances, and to recover reasonable collection costs, including attorney’s fees, for delinquent accounts where permitted by Indiana law.

Scheduling & Access

You agree to provide Kochs Electric’s personnel with safe, unobstructed access to the areas of your property where work is to be performed. This includes clearing the work area of furniture, personal belongings, or hazards prior to our arrival where applicable.

A responsible adult (18 years of age or older) must be present on the property during the performance of residential work unless we expressly agree otherwise in writing.

We will make reasonable efforts to complete work within scheduled timeframes. However, schedules may be affected by weather, supply chain availability, inspection backlogs, or circumstances beyond our control. We are not liable for delays caused by such factors.

If our technicians arrive at a scheduled appointment and are unable to access the property or are turned away through no fault of our own, a trip charge may apply.

Permits & Code Compliance

Where required by law, Kochs Electric will obtain the necessary electrical permits prior to beginning work. Permit fees are typically included in your estimate or billed as a direct pass-through cost.

All work performed by Kochs Electric is intended to comply with the applicable edition of the National Electrical Code (NEC) as adopted in Indiana, and with all applicable local amendments and ordinances.

Where existing conditions on your property are found to be non-compliant with current electrical codes, we may be required by law or professional obligation to bring those conditions into compliance as part of our scope, or to notify the appropriate authority. We will discuss any such findings with you prior to taking action where doing so does not create an imminent safety hazard.

Warranties

Workmanship Warranty: Kochs Electric warrants that all labor and workmanship performed by our technicians will be free from defects for a period of one (1) year from the date of project completion, unless a different warranty period is specified in writing.

Materials & Equipment: Materials, fixtures, and equipment installed by Kochs Electric are subject to the manufacturer’s warranty only. We do not extend additional warranty coverage beyond what the manufacturer provides. We will assist you in submitting warranty claims where practical.

Warranties are void if:

  • Work performed by Kochs Electric is subsequently modified, repaired, or disturbed by an unauthorized third party.
  • Damage results from misuse, abuse, neglect, acts of God, or circumstances outside our control.
  • The Client fails to notify us of a defect within a reasonable time after discovery.

Limitation of Liability

To the fullest extent permitted by applicable Indiana law, Kochs Electric’s total liability to you for any claim arising out of or related to our services – whether in contract, tort, negligence, or otherwise – shall not exceed the total amount paid by you to Kochs Electric for the specific services giving rise to the claim.

Kochs Electric shall not be liable for:

  • Indirect, incidental, consequential, or punitive damages of any kind.
  • Loss of use, loss of revenue, or business interruption.
  • Damage caused by pre-existing conditions on your property not disclosed to us prior to work commencing.
  • Damage resulting from work performed in reliance on inaccurate, incomplete, or misleading information provided by the Client.
  • Delays, failures, or damages caused by events beyond our reasonable control, including but not limited to utility outages, natural disasters, or governmental actions.

Nothing in these Terms limits our liability for personal injury or property damage caused by our gross negligence or willful misconduct, to the extent such limitation is prohibited by law.

Property & Site Conditions

You represent that you have the legal authority to authorize electrical work on the property where services are to be performed. If you are a tenant, you confirm that you have obtained any necessary consent from your landlord or property owner.

You are responsible for disclosing any known hazards, pre-existing conditions, or relevant property history that may affect the safety or scope of work – including the presence of asbestos, lead paint, prior water damage, or non-standard electrical configurations.

Kochs Electric takes reasonable care when working on your property; however, minor disturbances to walls, ceilings, or flooring may be necessary to complete electrical work. We will make reasonable efforts to minimize disruption and will inform you of anticipated disturbances in advance. Restoration of surfaces beyond our scope (such as patching drywall or repainting) is not included unless explicitly stated in the estimate.

Cancellation Policy

You may cancel or reschedule a scheduled appointment by contacting us at least 24 hours in advance with no penalty. Cancellations or rescheduling requests made with less than 24 hours’ notice may be subject to a cancellation fee to cover scheduling and preparation costs.

For contracted projects where work has already commenced, cancellation may result in charges for work completed to date, materials ordered or purchased on your behalf, and reasonable demobilization costs. These charges will be itemized and communicated to you clearly.

Kochs Electric reserves the right to decline or discontinue services at any time if site conditions pose a safety risk to our personnel, if we are unable to reach agreement on scope or pricing, or if there is a material breach of these Terms by the Client. In such cases, you will be billed only for work completed and materials procured up to the point of discontinuation.

Intellectual Property

All content on the Kochs Electric website at kochselectric.com – including text, images, logos, and service descriptions – is the property of Kochs Electric and is protected under applicable copyright and trademark laws. You may not reproduce, distribute, or use our content for commercial purposes without our prior written consent.

Proposals, drawings, schematics, and project documentation prepared by Kochs Electric remain our intellectual property until full payment for the associated project has been received, at which point the Client receives a non-exclusive license to use such documents in connection with the relevant property.

Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict-of-law provisions.

In the event of a dispute arising out of or relating to these Terms or our services, both parties agree to first attempt resolution through good-faith communication. If a resolution cannot be reached informally, disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Marion County, Indiana.

You agree to bring any claim or cause of action arising out of your use of our services within one (1) year of the date the claim arose, or such claim shall be permanently barred, to the extent permitted by applicable law.
